Abstrak:
Malpraktik dalam bidang kesehatan, meskipun seringkali digunakan dan disebut dalamkehidupan sehari-hari, secara formal tidak pernah mempunyai definisi yang jelas dantegas. Bahkan dari kalangan ahli hukum maupun ahli kesehatan, penggunaan istilahmalpraktik dalam bidang kesehatan ini masih diperdebatkan. Tesis ini melakukanpenelusuran literatur dan wawancara ahli untuk mencari tahu dan memberikan definisimalpraktik dalam bidang kesehatan. Tesis ini juga mencari tahu kriteria, jenis,penyebab, pembuktian dalam malpraktik, dan pilihan forum penyelesaian sengketamalpraktik dalam bidang kesehatan. Tesis ini memberikan masukan bahwa padadasarnya hubungan dalam pemberian jasa pelayanan kesehatan harus dilihat sebagaihubungan kontraktual. Kata kunci: malpraktik, kedokteran, kesehatan, hukum perdata, hukum perikatan,hukum perjanjian.

Abstrak:
ABSTRAK Anggaran dibidang kesehatan dari tahun ke tahun mengalami peningkatan sehingga memungkinkan untuk terjadinya tindak pidana korupsi. Whistleblowing system mampu secara efektif mengubah aktivitas tindakan tidak etis di organisasi. Penelitian ini bertujuan mengetahui faktor penentu intensi melakukan whistleblowing system pada Aparatur Sipil Negara di Kementerian Kesehatan dengan melihat persepsi pegawai terhadap komitmen organisasi, budaya organisasi, perlindungan hukum whistleblower, sikap profesionalisme, pelaporan internal, pelaporan eksternal, anonim, dan hotline. Melalui pendekatan kuantitatif dengan desain Cross Sectional, pengambilan sampel menggunakan probability sampling dengan teknik proportionate random sampling. Responden penelitian sebanyak 98 orang dari Direktorat Jenderal Pelayanan Kesehatan, Badan Pengembangan dan Pemberdayaan Sumber Daya Manusia Kesehatan, Direktorat Jenderal Pencegahan dan Pengendalian Penyakit, dan Direktorat Jenderal Kefarmasian dan Alat Kesehatan. Analisis data dilakukan dengan chi square dan regresi logistik. Hasil penelitian mendapatkan bahwa intensi melakukan whistleblowing system pada pegawai Aparatur Sipil Negara di Kementerian Kesehatan berhubungan dengan persepsi pegawai terhadap komitmen organisasi, budaya organisasi, sikap profesionalisme, perlindungan hukum whistleblower, pelaporan internal, dan hotline. Persepsi pegawai terhadap pelaporan eksternal dan anonim tidak berhubungan dengan intensi melakukan whistleblowing system pada pegawai Aparatur Sipil Negara di Kementerian Kesehatan. Sebaiknya Inspektorat Jenderal Kementerian Kesehatan melakukan reformasi pelaporan dari website menjadi aplikasi WBS Kemenkes untuk memberikan kemudahan dalam mengakses dan penggunaan, serta membuat Standard Operating Procedure (SOP) perlindungan hukum whistleblower untuk memperjelas perlindungan whistleblower. Kata kunci: Whistleblowing system, perlindungan hukum, whistleblower, sikap profesionalisme, pelaporan internal crime of corruption. Whistleblowing system capable of effectively revamp the unethical actions of the activities in the organization. The presence of this research aims to know the determinants of intention whistleblowing system at State Civil Apparatus of in the Ministry of Health to look at the perception of employees on organizational commitment, organizational culture, protection whistleblower, an attitude of professionalism, internal reporting, external reporting, anonymous, and hotlines. Through quantitative approach with the design using Cross-Sectional, sampling using a probability sampling technique with proportionate random sampling. The respondents of the research as much as 98 people at the Directorate General of Health Services, The Development and Empowerment of Human Resources for Health, Directorate General of Disease Control and Prevention, and the Directorate General of Pharmaceutical and Health tools with data analysis using chi-square and logistic regression. The results obtained that intention whistleblowing system to employees of the State Civil Apparatus in the Ministry of Health is related to employee perception of organizational commitment, organizational culture, an attitude of professionalism, protection whistleblowers, internal reporting, and hotlines. Employee perceptions of external and anonymous reporting are not related to the intention of whistleblowing system to employees of the State Civil Apparatus in the Ministry of Health. We recommend that the Inspectorate General of the Ministry of Health reform the reporting from the website into the application of WBS Kemenkes to give ease of access and usage and make Standard Operating Procedure to legal protection whistleblowers to clarify the protection of whistleblowers. Abstrak:
Salah satu dari fungsi hospital bylaws adalah sebagai sarana perlindungan hukum bagi semua pihak yang berkaitan dengan rumah sakit. Perlindungan hukum sangatdiperlukan saat tenaga kesehatan mendapatkan tuntutan. Salah satu hal yang dapat menimbulkan tuntutan adalah timbulnya Kejadian Tidak Diharapkan (adverse events). Tujuan penelitian ini adalah untuk mengetahui secara mendalam tentang bagaimana isi kebijakan hospital bylaws dalam upaya perlindungan tenaga kesehatanterhadap tuntutan adverse events dan kesesuaian isi kebijakan dengan pedoman yang ada. Desain penelitian dengan metode kualitatif. Hasil penelitian adalah kebijakan hospital bylaws RSKO Jakarta sudah memuat tentang upaya perlindungan hukum bagi tenaga kesehatan namun masih harus dilengkapi dengan pembuatan kebijakan teknis operasional lain dan masih ada ketidak sesuaian isi kebijakan hospital by laws dengan pedoman. Saran yaitu agar dapat dilakukan perbaikan isi kebijakan hospital by laws RSKO Jakarta, membuat kebijakan teknis operasional pendukung dan perbaikan pedoman hospital bylaws oleh pemerintah. One of the things that can cause the claim is unexpected incidence (adverse events). The purpose of this research is to know in depth about how thepolicy content of hospital bylaws in efforts to protect health workers against theclaim of adverse events and the content of policy conformance with existing guide lines. Abstrak:
Hukum dan etika adalah dua norma yang hidup berdampingan dalam masyarakat,yang mengatur perilaku manusia dalam mengambil keputusan. Dalam asuhankeperawatan yang dilakukan oleh perawat, khususnya perawat pelaksana di rumahsakit, pengambilan keputusan harus didasarkan pada hukum dan etika. Penelitianini dilakukan dengan mencari tahu konsep dan perkembangan asuhankeperawatan, hubungan dalam asuhan keperawatan, baik antara perawat denganpasien, dokter, sesama perawat, tenaga kesehatan lainnya atau dengan rumah sakitdi mana perawat bekerja, dan kegiatan asuhan keperawatan yang bersumber padakompetensi, otonomi dan kewenangan perawat, dan keberadaan hubungan .Penelitian ini adalah penelitian kualitatif dengan menggunakan data sekunderyang dilengkapi dengan wawancara informan. Penelitian ini menunjukkan bahwakompetensi, otonomi dan kewenangan, yang pada akhirnya melahirkan pertanggung jawaban profesi ners atau perawat adalah sumber dari segala macamaspek etika yang harus diperhatikan oleh perawat dalam menjalankan asuhan keperawatan dalam semua hubungan yang ada, baik antara perawat denganpasien, dokter, sesama perawat, tenaga kesehatan lainnya atau dengan rumah sakitdi mana perawat bekerja. Tidak dilaksanakan aspek etika dengan baik akanmembawa akibat pada pertanggung jawaban hukum, baik secara pidana maupunperdata. The research provesthat competency, autonomy, and authority, which finally arisen professionalliability (accountability) for nurse, are the sources from all ethical aspects thatmust be applied by the nurse in doing her care, in all kind of relation, eitherbetween nurse and the patient, medical doctors, co-workers, other health careprofessionals, or the hospital where the nurse works. Non-compliance to theethics will arise legal responsibility to the nurse, either criminal liability or civilaccountability.
